SMS Privacy Notice

This SMS Privacy Notice describes how IXACT Contact (“we,” “us”) handles information in connection with our SMS/text-messaging program. It supplements, and does not replace, our general Privacy Policy, which governs all other data collection.

1. Information We Collect

We collect information you provide directly to us, including your name, email address, and mobile phone number, when you inquire about a property, sign up for listing alerts, or request real estate services. If you interact with our website or lead-capture pages, we may also collect device and usage information through cookies and similar technologies (see Section 4).

2. How We Use Your Information

We use your information to provide, maintain, and improve our real estate services, including sending the following SMS communications:

  • Appointment confirmations and reminders for property showings;
  • Scheduling and follow-up messages;
  • Direct responses to your inquiries;
  • New listing alerts and market updates;
  • Transaction updates (offer progress, document requests, and closing reminders).

3. SMS and Mobile Information Protection

Your privacy is our priority. We do not sell, rent, or lease our customer lists to third parties.

No Sharing for Marketing: Mobile information, consumer opt-in data, and text-messaging originator data will not be shared, sold, or rented to any third parties or affiliates for marketing or promotional purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes at any time.

Service Providers: We may use a CRM platform or messaging service (such as Twilio) solely to facilitate delivery of these messages on our behalf. These providers are contractually prohibited from using your data for any other purpose.

4. Tracking Technologies and Your Choices

Our website and lead-capture pages may use cookies, pixels, and analytics tools to operate the site and understand usage. By using our site, you consent to these technologies as described in our general Privacy Policy. You can control cookies through your browser settings and may opt out of non-essential tracking where offered.

5. Your Consent and Opt-Out

Messages are sent only to users who have explicitly opted in to receive SMS communications. You may revoke consent at any time through any reasonable means, and we will honor opt-out requests promptly.

6. Your California Privacy Rights (CCPA / CPRA)

If you are a California resident, you have the right to: know and access the personal information we collect; request deletion; request correction; opt out of the sale or sharing of personal information; limit the use of sensitive personal information; and not be discriminated against for exercising these rights. We do not sell or share your mobile information. To exercise these rights, contact us at support@ixactcontact.com; you may use an authorized agent. California’s “Shine the Light” law (Cal. Civ. We retain personal information only as long as necessary to provide our services and to meet legal, accounting, or reporting requirements.
